TERMS AND CONDITIONS
Splitting Image will arrive approximately 60-90 minutes before the service period. If for any unforeseen reason we are unable to arrive until your event begins or need to arrive early, we will notify you as soon as we know. Occasionally operations may need to be interrupted for maintenance of the Photo Booth (changing photo paper, adjusting camera, adjusting printer, fixing unexpected lag, or returning to the event to complete such tasks etc.). Any additional time requested by host, if available, must be paid before additional time can be allowed.
INITIAL PAYMENT, FEES AND CANCELLATION CHARGES
An initial deposit payment of $50 of your total booking fee is required to secure your booking. This can be paid automatically through our online booking system.
Payment for extra time must be completed before time can be provided at your event. Extra hours provided must be paid in full via electronic payment or cash at the current rate. Any parking fees required to allow access to the venue or required for the delivery staff to remain at the event for the duration of the event or setup time must be paid by the client prior to the event.
All cancellations must be made by contacting us in writing at least ninety (90) days prior to the event. Once your event has been cancelled, your event date will immediately be available for other bookings. Please note - all refunds of monies paid will incur a fee to cover the transaction costs set in place by our 3rd party payment providers. Refunds may take up to 14 days to process.
Cancellation 31 days or more before the event - refund of the full amount of any monies paid excluding transaction fees.
Cancellation between 15 – 30 days of the event - refund 50% of any monies paid, excluding the transaction fees.
Cancellation within 1 - 14 days of the event – NO REFUND. At this point, it is usually too late for us to get another booking, which means we have lost other opportunities.
At the sole discretion of Splitting Image, LLC Photo Booth, event rental may be cancelled if payment is not made in full 14 days prior to event date.
Full payment is required at least 14 days before your event. An e-mail will be sent to you for final payment via our website.
VENUE, ACCESS, POWER AND LOCATION
It is your responsibility to ensure you have provided the venues contact information, address, name, and zip code for our attendants to find you. We also require that the venue allows reasonable access for loading, and suitable parking once the booth and equipment has been unloaded. If parking for loading is restricted, you will be liable for any fees/fines that occur as a result and or time used to seek a suitable location. We will arrive to set up approximately 60 - 90 minutes before the hire period is due to begin and require 45 – 60 to break down. If you require the booth to be set up earlier an idle time charge applies at the current rate.
Client will arrange for an appropriate space for the Photo Booth at the event venue. The photo booth setup requires a minimum space 10’ deep x 10’ wide x 10’ high, on a solid level surface. Client is responsible for ensuring power is available for the Photo Booth, (1) 120V, 10 amps, 3 prong outlet within 50 feet. The outlet must not be shared with any other appliance. Photo booth setup area should preferably be indoors especially during the day. If outdoors, client should ensure adequate shade from the sun to ensure good lighting of photos. Event may be cancelled, and payment forfeited if indoor or outdoor setup is not available upon arrival for setup. Client must provide an indoor setup if rain or inclement weather is forecast. The photo booth once setup will not be moved to avoid potential hazard.
If there is insufficient space for us to set up, you will still be charged the full hire amount.
It is your responsibility to inform us of any circumstances that may make setting up take longer, these may include but are not exhaustive to; going upstairs, a long distance from unloading area to set-up area, restricted access. If we are not aware of these and the set-up takes longer than normal your hire period may be intruded into.
Client agrees to, and understands the following:
a) Client will indemnify provider and its associates against any and all liability related to Client's and client’s guests’ use or misuse of the photo booth and props during or after Client's event including events arising from use of the photo booth by children.
b) Client will indemnify Provider and its vendors against any and all liability associated with the use of pictures taken within the Photo Booth, or by its representatives, employees or affiliates at Client's event.
c) Client will indemnify Provider from the time of service and on into the future, against any liability associated with said use.
The client agrees to and understands the following:
All guest (invited and uninvited) using the Photo Booth hereby give ((business name) the right and permission to copyright and use photographic portraits or pictures of any Photo Booth user who may be included intact or in part, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose. In addition, client hereby releases, discharges, and agrees that (business name), its employees/agents, and The Photo Booth and its related entities, from any liability that may occur or result from taking of pictures and photographs or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel, invasion of privacy, or unauthorized use of image. All photographs and pictures are the property of Splitting Image, LLC and The Photo Booth. The commercial use of the photographs and pictures without proper acknowledgement/permission from Splitting Image, LLC and The Photo Booth is prohibited. Splitting Image, LLC and The Photo Booth are not liable for missing photographs or pictures, if any. All permits and permissions required for The Photo Booth to photograph and be on location at the event whether for location, personal release, or any other cause, are the responsibility of the client to obtain that their expense if any. We respect your privacy so please let us know if you would like your photos to be kept private and not used.
EVENTS BEYOND OUR CONTROL
Splitting Image, LLC shall have no responsibility or liability to the Client for any loss, damage, delay or prevention of the completion of any booking resulting from an act of god, seizure, sanctions, quarantine restrictions, pandemic, epidemic, fire, volcanic eruption, earthquake, flood, windstorm, hurricane, weather, riots or civil commotion, strikes, labor stoppage, war or any other acts, matters or things, whether or not of a similar nature, which are beyond the control of Splitting Image, LLC. If an unforeseeable circumstance prevents Splitting Image, LLC from completing or makes it unreasonable for the Client to complete the booking contemplated by this Agreement, Splitting Image, LLC shall make reasonable efforts to provide alternative dates to the Client upon availability. Client fully agrees that all of client’s guests who use the Splitting Image, LLC are using the photobooth on their own free will and agree not to hold Splitting Image, LLC liable for any matters at all whatsoever that may arise in the future.
TERMINATION OF HIRE
Splitting Image, LLC will not tolerate any abuse or threatening behavior to our employees. If this occurs Splitting Image, LLC retain the right to terminate the hire, with no refund payable for hire time that has been cut short.
Splitting Image, LLC also retains the right to terminate a hire if they feel that any equipment or property belonging to Splitting Image, LLC is in danger of being damaged or has been damaged due to unruly behavior from you or your guests. We also reserve the right to refuse guests to participate in the activities if we feel they are too unruly.
In any instances where we feel there is a need to terminate the hire, we will attempt to speak with you or the hosting venue first, if possible, to try to resolve the matter before termination.
In the event of any damages caused by those present, to property or equipment in use by Splitting Image, LLC, you will be charged the full replacement cost and are liable for the cost involved in termination of future events due to sourcing replacements. Client is liable for a $100 damage or replacement fee for damaged or missing props not returned be the end of the event.
Any damages must be reported to a member of Splitting Image, LLC staff immediately.
